There are three types of contractors in considering DAS 140 & DAS 142 filings:

1. Union signatory contractors
2. Merit shop contractors who are signatory to a Division of Apprenticeship Standards (DAS) approved apprenticeship program
3. Merit shop contractors who ARE NOT signatory to a DAS approved apprenticeship program

The type of contractor determines how to comply with the stringent California DIR apprenticeship regulations:

DAS 140

All Contractors must file the DAS 140 PRIOR to staffing the project. There is NO opportunity to correct non-compliance on a late DAS 140 filing. DO NOT STAFF YOUR PROJECT UNTIL THIS FORM HAS BEEN FILED.

Union signatory contractors & Merit shop signatory contractors

Union & Merit shop signatory contractors & subcontractors are required to notify the apprenticeship committee to which they are signatory of the award of a contract by submitting a copy of the Division of Apprenticeship Standards (DAS 140) form for each trade to be used.

– Must be submitted within 10 days of the date of the execution of the contract, but in no event later than the first day in which the contractor has workers employed on the project.

Merit shop contractors who ARE NOT signatory to a DAS approved program:

All public works contractors & subcontractors if they are NOT APPROVED TO TRAIN are required to notify ALL apprenticeship committee’s in the county the work is to be performed in of the award of a contract by submitting a copy of the Division of Apprenticeship Standards (DAS 140) form for each trade to be used by an approved program.

– Must be submitted within 10 days of the date of the execution of the contract, but in no event later than the first day in which the contractor has workers employed on the project.

DAS 142

Union signatory contractors & Merit shop signatory contractors:

All public works contractors & subcontractors APPROVED TO TRAIN are required to request dispatch of apprentices from THEIR local apprenticeship committee’s by submitting a copy of the Division of Apprenticeship Standards (DAS 142) form for each trade to be used (unless expected to meet the required minimum ratio.)

• EXCEPTION: If they cannot meet their minimum ratio, additional DAS 142 filings may be required.

NOTE: Must be submitted at least 72 hours before the date on which apprentices are required on the project (excluding Saturdays, Sundays and holidays).

 

Merit shop contractors who ARE NOT signatory to a DAS approved program:

All public works contractors & subcontractors NOT APPROVED TO TRAIN are required to request dispatch of apprentices from ALL local apprenticeship committee’s in the county where the work is to be performed by submitting a copy of the Division of Apprenticeship Standards (DAS 142) form for each trade to be used (unless expected to meet the required minimum ratio.)

What Constitutes Compliance?

Union signatory contractors & Merit shop signatory contractors:

If you have met your minimum required ratio and you have filed your DAS 140/142 with your approved program, you have fulfilled your obligation.

If you have not met your minimum required ratio and you have filed the DAS 140 with the association to which they are signatory AND you have filed the 142 with ALL apprenticeship committee’s because you DID NOT meet your minimums, you have fulfilled your obligation.

NOTE: This includes contractors who are approved to train in a county other than the county where the work is performed but the program is not approved in the county where the work is performed. (PLA’S are NOT exempt from this)

 

Merit shop contractors who ARE NOT signatory to a DAS approved program:

If apprentices are NOT dispatched and you have filed both the DAS 140 & 142 with ALL apprenticeship committees, you have fulfilled your obligation.

If apprentices ARE dispatched and you are not meeting your minimum ratios, you must file ADDITIONAL DAS 142 requests throughout the project to show due diligence to comply.
