We have been telling our clients since the beginning of 2013, that employers must provide mandatory notices to their employees by October 1, 2013 informing them of their right to enroll in the Health Care Exchange. If the model health exchange notices weren’t distributed to employees, the Department of Labor (DOL) was going to fine businesses $100 a day until each employee received the notice.  As of September 11, 2013 the DOL held a press conference indicating that the exchange notices were no longer mandatory and no businesses were going to be fined if they failed to distribute the literature.  Crazy, huh?

If you already handed out the exchange notice, there is nothing for you to do, you have gone above and beyond.  Notifying the employees will increase awareness of the exchange and will help employees that are interested in making an election through the marketplace be more informed.
