The government has been temporarily shut down for a little over a week and Obamacare questions are lingering. We don’t know how long the government will be shut down but we do know the new California Laws that are changing with Obamacare.

Does your employee new hire waiting period meet the new requirements? Whether you are a large or a small group, the new law applies to both group sizes. California AB 1083, sets a strict 60 day waiting period that begins from the date of hire to when coverage must be provided to the employee. If you have a self-funded plan, you must comply with the maximum 90 day waiting period. You will need to adjust your waiting period by your renewal date in 2014.

What is the definition of a full time worker? California AB 1083 defines anyone who works an average of 30 hours a week as a full time worker. This definition change will be applied to all new policies purchased January 1st and to current policies renewing in 2014.

Are plan designs affected by any law requirements? Yes. California law SB 639, limits maximum deductible amounts in 2014 for the Covered California Silver, Gold and Platinum plans to be $2,000 single / $4,000 family. The Bronze plans that are offered can have higher deductibles but are required to meet a 60% value.
